1. LEGAL INFORMATION
In accordance with the provisions of Article 10.1 of Law 34/2002 of July 11, 2002, on services of the information society and electronic commerce (the “LSSI”), it is hereby stated that the service provider is FUNWAY ACADEMIC RESORT S. L with trade name FUNWAY ACADEMIC RESORT, hereinafter referred to as FUNWAY, with registered office at Calle Alonso Castrillo 22, Madrid 28020 with CIF B-87474169, registered in the Mercantile Registry of Madrid in Volume 34332, folio 193, Sec. 8, sheet M-617552, Ins 1. 2. CONTRACTING
2.1. In accordance with the provisions of Article 27.1.a) of the LSSI, the contracting through www.e-kilibrio.com will be carried out in accordance with the following:
2.1.1. Step 1: selection of the desired dates of stay.
2.1.2. Step 2: selection of the number of guests and rooms.
2.1.3. Step 3: selection of the type of room.
2.1.4. Step 4: insertion of the personal data relating to the reservation and, if applicable, of the bank card used as a means of payment for the reservation and acceptance of the reservation conditions.
2.1.5. Step 5: Verification of the data related to the reservation made.
2.1.6. Step 6: formalization of the reservation and display of the relevant confirmation page.
2.1.7. Step 7: sending of a booking confirmation email with booking details.
2.2. FUNWAY will generate a comprehensive electronic document of the booking confirmation for archiving. The customer will receive access and full knowledge of this file by sending an email with its content at the end of the reservation.
2.3. The legal clause regarding the right of withdrawal shall not apply to reservations made through www.funwayresort.com or the telephone reservation service, being in any case applicable to the particular conditions of the offer regarding cancellation. To make the cancellation effective, you must contact directly with the chosen hotel at the telephone number, postal address or e-mail address provided in the confirmation message of the reservation, providing the identification data of the reservation.
3. All content included on this website, including but not limited to articles, texts, designs, photographs, images, logos, videos, audios, databases, software and the website as a whole correspond to FUNWAY in its capacity as owner of the domain and / or entity entitled to use it under the license granted by third parties, so it is forbidden to use it without the express prior authorization.
The trademarks, trade names, logos and any other distinctive signs found on this website are the property of FUNWAY or this entity has the corresponding license for use for insertion on the website.
In the absence of express authorization, the user is prohibited from reproducing, distributing, publicly communicating and transforming the contents for commercial or lucrative purposes.
4. GENERAL CONDITIONS OF THE ACCOMMODATION
4.1. Pricing policy:
4.1.1. Rates are quoted for single or double occupancy per unit.
4.1.2. The published rates include all taxes.
4.1.3. The price of the room only corresponds to the accommodation and does not include any additional service (food, parking or other).
4.1.4. In the cases that the room allows the additional guest will have to pay the amount of 24.00 Euros per night, taxes included.
4.2. Children under 02 years of age (Infants) stay free of charge. We have available and upon request cribs to meet the need of infants.
4.3. Children over 02 years old and under 12 years old must pay the amount of 16.00 Euros per night, taxes included.
4.4. Payments shall be made in Euros only, and may be paid with Cash (provided that the amount of the accommodation does not exceed 500 Euros), or by Visa, MasterCard or American Express debit/credit cards.
4.5. Direct deposits, bank transfers or personal checks must be previously agreed with our reservations and accounting department, and proof of bank transactions must be sent by e-mail to: info@funwayresort.com.
4.6. In order to reserve your room, payment must be made prior to the client’s arrival.
5. RESERVATIONS
5.1. Reservations: Rooms are subject to availability and the hotel reserves the right to refuse any reservation.
5.2. Services included in the rate:
5.2.1.Accommodation.
5.2.2. The use and enjoyment of the equipment and appliances included in the accommodation units with the exception of the washing machine (Additional cost).
5.2.3. Safety box in the room.
5.2.4. Internet connection.
5.2.5. Use of the gymnasium and common areas such as the TV room or study room.
5.2.6. Use of swimming pool.
5.3. Services NOT included in the rate:
5.3.1. Laundry service.
5.3.2. Consumption in the Cafeteria. 5.3.3.
5.3.3. National and international telephone calls. 5.3.4.
5.3.4 Other services not specified in the rate.
5.4. Guarantee: In order to guarantee the lodging in all situations, 100% of the reservation must be paid in full.
5.5. Persons with reduced mobility: FUNWAY is partially equipped for the needs of its clients with disabilities. We have adequate access to reach most of the rooms. We also have some rooms suitable for the accommodation of persons with reduced mobility.
Pets: FUNWAY is a PET FRIENDLY property, pets (only small dogs up to 10 kg in weight) are accepted inside the rooms, with an additional charge.
5.7. FUNWAY has a free luggage deposit available to guests for a few hours before and/or after their departure.
5.8. Parking: Parking service is offered at an additional cost during the guests’ stay.
5.9. Security Deposit: FUNWAY will make, at the time of check in, a pre-authorization (block) of 150 Euros as a guarantee for damages and/or losses that may occur during the stay. This security deposit will be released or reversed once the condition of the room has been verified. This amount is not limitative and may be higher depending on the damages or losses that occur inside the room and for which the person holding the reservation is responsible, as well as jointly and severally with his/her companions.
6. RULES OF CONDUCT AND RIGHT OF ADMISSION
6.1. FUNWAY reserves the right of admission.
6.2. FUNWAY reserves the right to refuse entry to guests and accommodations if, upon arrival, management reasonably believes that the guest is under the influence of alcohol or drugs, is inappropriately dressed, or is behaving in a threatening, abusive or otherwise unacceptable manner.
6.3. The hotel reserves the right to require a guest to leave if he/she is causing a disturbance to other guests or hotel staff or behaving in an unacceptable manner.
6.4.Guests shall comply with all reasonable rules and procedures in force at the hotel, including, but not limited to legal requirements, safety, health and security procedures regarding check-in.
6.5. Smoking is strictly prohibited in the hotel rooms and common areas. FAILURE TO COMPLY WITH THIS POLICY will result in the automatic charge of the amount given in guarantee made by the guest at the time of Check in.
7. HOTEL HOURS
7.1. FUNWAY has a reception desk open 24 hours a day, 7 days a week.
7.2. Arrival (Check In) and Departure (Check Out) Hours:
7.2.1. Arrival Time: Check in is after 14:00 on the day of arrival.
7.2.2. Check Out Time: Check Out is before 13:00 on the day of departure. The guest may request an extension of hours, which may or may not be agreed upon by the hotel against an additional Late Check Out charge. In case the guest does not check out within the period indicated above and has not requested an extension (Lat Check Out), it will entitle the hotel to charge for an additional night. Charges will be at the hotel’s current rates which are available upon request. Guests must pay all outstanding charges at check out. If a balance remains unresolved at check-out, payment will be charged against the guarantee given at check-in.
7.2.3. Early check in or late check out: It is possible to request early check in or late check out, but must be informed in advance to the receptionist before or during the stay. These services have an additional cost.
7.3. Cafeteria:
Breakfast hours: Open from Monday to Sunday from 7:00 hrs to 10:00 hrs.
7.4. Common Areas Schedule:
TV room: Open from Monday to Sunday upon request and reservation at the reception. 7.4.2.
7.4.2. Swimming pool area hours: Open Monday to Sunday from 9:00 hrs to 22:00 hrs.
7.4.3. Gym area opening hours: Open from 6:00 hrs to 22:00 hrs.
8. GUEST RESPONSIBILITIES
8.1. Responsibilities:
8.1.1. Guests must report any loss or damage to their property immediately to the hotel front desk or other appropriate staff members, and must be available to assist with reports made by the hotel to the police.
8.1.2. Guests may not enter areas of the hotel that are indicated as closed to the public.
8.1.3. FUNWAY is not responsible for any loss or damage to valuables that the guest fails to declare and/or leaves outside the safety deposit box in the room.
FUNWAY shall not be liable for any loss or damage caused to a guest’s vehicle, unless caused by the fault of the hotel. Guests will be responsible for any loss, damage or personal injury they may cause at the hotel and the hotel may claim such amounts from debit or credit card details supplied at the time of booking or arrival.
8.1.5. The guest undertakes to maintain and respect the noise level so as not to interfere with or disturb other guests. If on any occasion you are asked more than once to avoid noise levels, the hotel staff has the right to ask you to leave the hotel and shall not be entitled to any refund.
8.1.6. Prostitution and exploitation of underage persons is not permitted under any circumstances.
9. ACCOMMODATION CANCELLATION POLICIES
9.1. Individual reservations made through the website www.e-kilibrio.com are non-refundable and one hundred percent guaranteed, and no refund can be requested for cancellation of the reservation.
9.2. NO SHOW: In case of no-show of the guest without prior notice within 72 hours of arrival, in all cases, 100% of the value of the reservation will be charged as a penalty without refund.
9.3. EARLY CHECK OUT: In case of early check out, in all cases, there is no refund for the unused nights of the reservation.
